1. Introduction
Welcome to Akashi Hosting! By using our services, you agree to comply with these Terms of Service ("TOS"). If you do not agree, please do not use our services.
2. Service Usage Policies
- You may not use our services for any illegal, abusive, or malicious activities.
- Content that violates laws, including copyright infringement, hacking tools, or child exploitation material, is strictly prohibited.
- We reserve the right to refuse service to anyone at our discretion.
- Misuse of server resources, such as excessive CPU, memory, or bandwidth consumption, may result in throttling, suspension, or service termination.
3. Fair Use Policy & Claw Act
- Our services operate under a Fair Use Policy to ensure all users have a stable and reliable hosting experience.
- Free/Trial products come with strict limitations (one per customer, no email support, restricted CPU/memory usage, etc.).
- If your free/trial server is inactive or exceeds fair use limits, Akashi Hosting reserves the right to suspend or revoke access without prior notice.
- Paid services that significantly overuse resources may require an upgrade or be subject to suspension.
- Akashi Hosting reserves the right to reclaim or suspend underutilized services as part of our Claw Act, ensuring fair distribution of resources.
4. Billing, Payments, & Refunds
- All payments must be made on time. If a payment fails, services may be suspended immediately.
- Refunds are only available within 48 hours of purchase, except for domain registrations, licenses, and third-party services, which are non-refundable.
- Chargebacks or disputes will result in immediate account suspension.
- If an account remains unpaid for 7 days, Akashi Hosting reserves the right to terminate the account and delete all associated data permanently.
- All fees must be paid before a service is recovered or started after suspension.
5. Account Suspension & Termination
Accounts may be suspended or terminated for:
- Violating these Terms of Service.
- Repeated unpaid invoices.
- Using services for malicious purposes.
- Failure to respond to security or abuse reports within 24 hours.
Suspension & Data Retention:
- Suspended accounts may be restored within 7 days upon resolving the issue. After this period, data may be permanently deleted.
- Terminated accounts cannot be recovered, and no refunds will be issued.
- Users who violate the Terms of Service may be banned from Akashi Hosting and its partner services.
6. Prohibited Activities & Content
Users may not host or engage in activities related to:
- DDoS attacks, botnets, or hacking tools.
- Fraud, scams, or phishing websites.
- Hosting malware, viruses, or illegal content.
- Cryptocurrency mining without prior approval.
- Spam, unsolicited emails, or bulk mailing operations.
- Copyrighted or trademarked materials without proper authorization.
7. Security & Account Responsibility
- Users are responsible for maintaining the security of their account credentials and servers.
- Akashi Hosting will not be held liable for unauthorized access due to weak passwords or negligence.
- Accounts with repeated security issues may be required to undergo verification or additional security measures.
- Each user is allowed only one account. Multiple accounts will be subject to termination.
8. Backups & Data Protection
- Akashi Hosting does not perform backups for any service.
- Our services may provide tools or access for users to create their own backups.
- Users are solely responsible for keeping and maintaining their own data backups.
- We do not guarantee recovery of data in the event of loss.
9. Technical Support & Service Level Agreement (SLA)
- Standard support is provided via tickets, live chat, and knowledge base resources.
- Support does not cover third-party software, unmanaged VPS issues, or custom configurations outside of Akashi Hosting’s default environment.
- Emergency support is available for critical issues affecting server uptime but may be subject to additional fees.

10. General Data Protection Regulation (GDPR) Compliance
- We are committed to complying with GDPR regulations to protect the privacy and security of user data.
- Users have the right to access, modify, or delete their personal data in compliance with GDPR.
- Personal data is never shared with third parties unless required by law or necessary for service provision (e.g., domain registration).
- Users may request data deletion by submitting a formal request via the support portal.
- Akashi Hosting implements industry-standard security measures to prevent data breaches. In the event of a breach, affected users will be notified in compliance with GDPR requirements.
11. Akashi Hosting Assistance Program
- Akashi Hosting provides hosting services for up to 18 financially struggling users for a maximum period of 3 months.
- Users applying for this program must provide bank history records for the past 3 months to verify that they have not had any income during this period.
- Services provided under this program are strictly temporary and non-renewable.
- If financial conditions improve within the 3-month period, users are required to upgrade to a paid plan.
- Abuse or misuse of this program (e.g., falsifying documents) will result in immediate termination and a permanent ban from Akashi Hosting services.
- Akashi Hosting reserves the right to verify submitted documents and conduct additional checks.
- This program is not applicable to users who have been suspended or banned from Akashi Hosting services for violations of the TOS.
- Akashi Hosting may collaborate with partner organizations to expand or enhance this program.
12. Newbie User Policy
- Akashi Hosting welcomes new users and aims to provide an accessible and user-friendly environment.
- Support staff may prioritize helping new users understand system tools, best practices, and limitations.
- New users are encouraged to explore our knowledge base and seek assistance through our ticket system for guidance.
- No additional resource limitations are placed on new users unless required for technical or security reasons.
- Akashi Hosting offers staff-led mentorship only for new users. Community mentorship is not permitted to protect customer privacy and data.
13. Resource Abuse Protection (Auto-Suspension Policy)
- To ensure stability for all users, Akashi Hosting employs automatic monitoring tools.
- Services consuming abnormal levels of CPU, RAM, or bandwidth may be temporarily suspended without notice.
- Users will be notified and may be required to upgrade their plan or optimize their usage before reactivation.
14. Legal Jurisdiction
- These terms are governed by the laws of Sweden and applicable European Union regulations.
- Any legal action must be filed in accordance with Swedish law.
15. Reseller Responsibilities
- If you resell Akashi Hosting services, you are fully responsible for your clients’ actions.
- Misuse or violations by your clients may result in your account being suspended or terminated.
- Resellers must provide proper support to their customers and ensure they comply with our TOS.
16. Promotions, Discounts & Referral Programs
- Users may not abuse promotional codes, discounts, or referral programs.
- Creating multiple accounts to claim coupons or offers is strictly prohibited.
- Akashi Hosting reserves the right to revoke promotional benefits or suspend users abusing the system.
17. Service Migration & Termination Policy
- Akashi Hosting may migrate or sunset older servers or services as needed for performance or security.
- Users will be notified in advance of any major migration or end-of-life decisions.
- We strive to minimize disruption and provide options where possible.
18. Changes to Terms of Service
- We reserve the right to update these Terms of Service at any time.
- Users will be notified of major changes via email or announcements.
- Continued use of our services after changes means you accept the revised terms.
19. Parental Control & Child Accounts
- Parents or legal guardians must create and manage their child's account if the child is under 13 years old.
- Parents are required to enable User Management to oversee the child's account activities, payments, and server usage.
- Parents remain responsible for all transactions and activities made through their child's account and may request refunds or account changes directly via the parent's linked account.
